↑↑これはちょっと違うと思います。

ＧＰＬのcondition 5 にも
5. You are not required to accept this License, since you have not 
signed it. However, nothing else grants you permission to modify or 
distribute the Program or its derivative works. These actions are 
prohibited by law if you do not accept this License. Therefore, by 
modifying or distributing the Program (or any work based on the Program), 
you indicate your acceptance of this License to do so, and all its terms

今回のＦＳＦ案でも
 (10) You are not required to accept this License, since you have not

となっており、これら条項が言わんとしてることは、「このライセンスは強制し
ないけど、著作権法によって、オイラの許諾がない限り、複写改変行為はできな
いんだから、勝手に利用してたら、このライセンスを受諾したものと推定される
よ」ということです。個別に著作権者と別契約を結んでいる人でない限り、この
推定を覆すのは難しいです（現実的には不可能だと思います）。

ぶっちゃけて言えば、この項がＧＰＬのキモというか、「オープンコミュニィテ
イに逆らうやつにはつかわせないぞー」という戦線布告部分です。

ただし、複写行為なくして単純使用のみしている人（誰か既にインストールした
ソフトを利用、とか）について利用許諾契約がいかなる意味をもつか、というの
は大論点でして、たぶん、まつもとさんのご記憶部分はその話だと思います。
