FSF は著作権譲渡を要求することがありますが、その時には書面の 
disclaimer(権利放棄証明文)を要求して相手の意思を確認しているはずです。

これは、Tacosさんがおっしゃっている Ruby の 「コミュニティ内の黙示の契
約」という話とは違うと思います。

誤解を招くといけないので強調したいのですが、私はライセンスを変えること
自体に反対ではありません(変えるなら BSD にしてほしい ;-)。ようするに、
まつもとさんにそのような書面を*全員*からいまさら集める気がおありなので
すか、そこまでする必要が今あるんですか、ということだと思うのですが。

ちなみに私は Emacs の事情は良く知りませんが、私が参加している Free
Translation Project (各種ソフトウェア向けの ja.po などを管理)では以下
のようなことを謳っています。ちょっと長いですが引用します。

For most packages collaborating with the Translation Project, the
translations should be disclaimed in writing by the translators,
before being accepted for inclusion in the distribution. There are
forms that translators should fill once and send to the Free Software

すなわち、書面での disclaimer が必要と言っています。
 
The Free Software Foundation acts like a kind of attorney that
witnesses the disclaimer. Some translators mis-read the translation
disclaimer as assigning the translation works to the FSF, and are
disturbed by this impression. This is not really the case. Once again,
the FSF acts as a recipient and attorney for your papers, not as an
assignee.

といってFSFが権利を奪うのではなく、弁護士や証人のようにふるまう(権利を
委託されて管理?)だけだと言っています。

The translator usually disclaims all translations he or she could
produce for any package. Yet, precisely, the need for disclaimers is
decided on a per package basis. When a maintainer asks for
disclaimers, disclaimers are needed for all translations coming from
any team for that package. For GNU packages, maintainers do not really
have a choice, as the GNU project requires disclaimers for almost all
its packages. For non-GNU packages, the choice is up to the package
maintainer. The safest for translators is to fill and return
disclaimers, in this way, they put themselves free, once and for all,
to work on all translations they will feel like, whether GNU or not.

Emacs は GNU プロジェクトの一つですから、disclaimer を要求するというの
はまつもとさんのおっしゃるとおりですね。
