My Ruby installation had this update.  I switched it to be <=1.2.3, which solved the problem.

I encounter this problem with home made gems. 
Applying the patch did help at one point but the problem reoccurs from time to time with other gems. 

I found that adding one or two white spaces in one of the files to be package and rebuilding a new gem solves the problem. (reminds me of early Microsoft ASP)

(my distrib uses zlib 1.2.3)

Versions :

Microsoft Windows XP 
ruby 1.8.4 (2006-04-14) [i386-mswin32]
zlib1.dll : 1.2.3.0
