And I can't reproduce it, either; they both seem to return Sets:

$ irb -r set
irb(main):001:0> s = Set.new [1,2,3,4]
=> #<Set: {1, 2, 3, 4}>
irb(main):002:0> t = Set.new [2,4,6,8]
=> #<Set: {6, 2, 8, 4}>
irb(main):003:0> s | t
=> #<Set: {6, 1, 2, 8, 3, 4}>
irb(main):004:0> s & t
=> #<Set: {2, 4}>
irb(main):005:0>
