My own belief is that that might be ok.  I don't think this is though:

neelix hgs 57 %> ruby -e 'p Time.local(1997,12,31,23,59,0)'
Wed Dec 31 23:59:00 GMT 1997

because it is legal to add a leap second at the end of the year.
