A 'non-confoming XML parser' is no XML implementation. The XML spec requires conformance. There are many scenarios where one implementation reads its' own output, and there are many scenario where it needs to read data from other implementations. There are many scenarios where a simple subset of XML is sufficient, and therea are many scenarios where it's not. The conformance requirement of the XML spec ensures that all XML implementations are useful for all these scenarios.
