法律家ではありませんが一応学んだので安全側に振っておきますと、

のテンプレートにそったライセンスのようですが、文面としては、
if the permission statement was included
  if without fee
    permit any purpose of use etc.
  end
end
であって、else には一切言及されていないように感じられます。

しかし、著作権においては原則著作権者が複製権等を占有していますので、
ライセンスの文章のみでは有償の場合は許諾されていない状態となります。
つまり、著作権者は複製権等を行使できると考えるべきでしょう。
「販売禁止」というと語弊があるのですが、まぁそういうことだと思います。

今回は ruby-dev:31554 で作者の方から no bearing との言葉を
いただいていますから問題はないでしょうが、
昨今の Ruby を取り巻く環境を考慮しますと、
著作権表示は残した上で、ライセンスは Ruby License / GPL での配布を
許諾していただいた方が望ましく思います。
