It's a parser thing. The parser uses the presence of = to know whether to
declare or assign a variable. I'm not sure how you'd get around that, unless
you had = be a method on Kernel that instantiates a variable in an
appropriate scope. Still, it would be very weird.

It's a bit like . or , or () in that regard, which are also un-modifiable
operators.
