Backport to Ruby 1.8 is only security issues now.  [ruby-dev:47201]

So this issue is not acceptable now.

 (that's not a real error)
 
 Fails on
 ruby 1.8.6 (2009-03-31 patchlevel 368) [i386-mingw32]
 
 Works fine/well on 1.9 though.
