a simple bug:
ary = [1, 2, 3]
ary.freeze
ary.instance_eval { initialize }
ary.empty? # true
ary.frozen? # true
The rb_ary_modify(ary); line in rb_ary_initialize either needs to be
moved before the rb_scan_args(...) == 0 case or duplicated there.
It seems to have been fixed in 1.9. Not sure if it's already in the
latest 1.8.
